According to court documents, both Jeremiah and Jedediah exited the vehicle near the home. A struggle ensued between the brothers and the trooper when Jeremiah went to his hands and knees but refused to go to the ground after several warnings from the trooper.

After several obscenity laced tirades Jeremiah directed at the trooper, in which he told the trooper he will "bury you," Jedediah said he was going to get a shotgun, according to court documents.

Jedediah then allegedly grabbed the trooper's arm to attempt to free his brother from the trooper's grasp, bruising her arm. He continued to walk toward the house stating he was going to get his shotgun when Starbuck Police Chief Jim Minion arrived on the scene as backup and helped get Jeremiah to the ground.

According to court documents, Jedediah emerged from the house with a shotgun pointed toward the sky. Both officers pulled their weapons and ordered Jedediah to the ground, but he did not comply.

After walking around for a short time, Jedediah allegedly said he may as well unload the Remington 870 .12 gauge, and proceeded to unload the gun of three shotgun shells. From there, Jedediah was arrested and emitted a strong odor of alcoholic beverages on his breath, according to court documents.
